General terms and conditions of sale
from SAS OPALE EVENTS "La Terrasse"
1. Purpose
These General Terms and Conditions of Sale (GTC) are intended to define the terms and conditions of the event services offered within the reception hall of "SAS OPALE EVENTS " LA TERRASSE" registered with the Dunkirk Trade and Companies Register under number 104 698 493 (SIRET: 104 698 493 00012), for the organization of events such as weddings, birthdays, corporate seminars, meetings, cocktail parties, etc.
2. Booking and Payment
2.1 All bookings must be confirmed in writing, accompanied by a deposit of 50% of the total cost of the service. The balance must be paid on the date of the event.
2.2 In the event of non-payment within the stipulated time limits, "SAS OPALE EVENTS " LA TERRASSE" reserves the right to cancel the reservation.
3. Cancellation
3.1 In case of cancellation by the client:
• If the cancellation takes place at least 7 days before the date of the Operation, "SAS OPALE EVENTS " LA TERRASSE" reserves the right to retain the deposit paid or to demand payment of an amount equivalent to 50% of the total amount of the service.
• If the cancellation takes place less than 7 days and at least 48 hours before the start of the Operation, "SAS OPALE EVENTS " LA TERRASSE" reserves the right to keep the deposit paid or to demand payment of the amount equivalent to 70% of the total amount of the service.
• If the cancellation takes place less than 48 hours before the date of the Operation, the client will be required to pay the full amount of the service.
3.2 In the event of cancellation by SAS La Terrasse due to force majeure (fire, flood, etc.), the sums paid for the cancelled service will be fully refunded to the client.
3.3 In the event of cancellation of the service by SAS OPALE EVENTS “LA TERRASSE”, the client is informed as soon as possible and the sums paid for the cancelled service are fully refunded to him, without prejudice to his other legal rights.
4. Responsibility and Damage
4.1 The client is responsible for any damage or deterioration caused to the reception hall or any other property belonging to SAS OPALE EVENTS "LA TERRASSE" by himself or his guests, and will be required to reimburse the full cost of repair or replacement.
4.2 The agreed-upon services and deliverables are specified in the quote accepted by the client. Any additional services must be subject to prior agreement regarding their content and price.
5. Noise pollution and domestic animals including exotic pets.
5.1 The client agrees to respect the neighborhood and to limit the noise level, particularly after 10 p.m. Failure to comply with this clause may result in the immediate termination of the event without refund or compensation.
5.2 "Domestic animals, including exotic pets, are not permitted to enter or be present on the premises of the 'La Terrasse' reception hall. Guide and assistance dogs are permitted in accordance with applicable regulations. For all other animals, this prohibition applies to any booking or use of the hall, in order to preserve the hygiene, safety, and comfort of all clients and event participants. Any person violating this provision will be held liable for any damages and may be refused entry or asked to leave the premises without notice or refund."
6. Room capacity
The maximum capacity of the reception hall must not be exceeded. The client agrees to respect the maximum capacity of the reception hall indicated at the time of booking.
7. Right of Withdrawal
For catering services or leisure activities booked for a specific date or period, the right of withdrawal does not apply, in accordance with Article L221-28, 12° of the French Consumer Code. For other services, the applicable legal rules regarding withdrawal remain in effect.
8. Safety, Responsibility and Insurance
8.1 "SAS OPALE EVENTS " LA TERRASSE" declares and guarantees that the premises, the subject of this contract, comply with the laws and regulations in force, and in particular with the regulations concerning the safety of premises and Public Access Buildings (ERP). The client acknowledges this declaration.
8.2 The client must comply with all applicable laws and regulations, including those concerning the safety of premises and public access buildings, in accordance with the terms of this contract and the internal regulations applicable to SAS OPALE EVENTS "LA TERRASSE". The client declares that they are aware of and accept them without reservation.
8.3 Both parties agree to take out insurance policies covering their own property and their civil liability towards third parties. The client declares that they have taken out all the insurance necessary for the purpose of this contract and agrees to provide a certificate of civil liability insurance to SAS OPALE EVENTS "LA TERRASSE".
8.4 The client must take out insurance covering equipment belonging to them or brought by them or by any person acting on their behalf, in particular sound equipment, lighting, decorations, etc. The client must provide proof of insurance at least 7 days before the event.
8.5 Each party remains liable for damages attributable to it under the conditions provided by law. Nothing in these Terms and Conditions deprives the customer of their legal rights to compensation.
9. Telephone solicitation opt-out list
The telephone number collected during booking or when purchasing a gift certificate is used solely for order tracking and is never used for telemarketing. In accordance with Article L.223-2 of the French Consumer Code, consumers are informed of their right to register on the national opt-out list for telemarketing calls. 10. Copyright and SACEM
If the client plans to play music during their event, it is their responsibility to obtain the appropriate authorization and pay the corresponding royalties to the Society of Authors, Composers and Music Publishers (SACEM) or any other copyright management organization. "SAS OPALE EVENTS " LA TERRASSE" cannot be held liable under any circumstances for the client's failure to pay these royalties.
11. Disputes / Mediation
In accordance with Article L612-1 of the French Consumer Code, "SAS OPALE EVENTS "LA TERRASSE" has established a consumer mediation service. In the event of a dispute, consumers can contact the mediator by visiting the website https://www.cm2c.net and going to the "Report a Dispute" section, then entering the company's SIRET number (French business registration number) mentioned at the top of this text. The mediator is the Centre de la Médiation de Consommation de Conciliateurs de Justice (CM2C), located at 49 rue de Ponthieu, 75008 Paris, France.
12. Dance Parties/Performances
"12.1 Tickets purchased for the dance party are non-refundable except in the event of cancellation of the event by the organizer. No refund will be given for any cancellation or no-show by the customer.
12.2 Appropriate attire is required for entry to the dance party. Participants are requested to dress appropriately and respectfully for the event. The organizer reserves the right to refuse entry to anyone not meeting these dress requirements, without any right to a refund or compensation.
